Term Of Use

DEFINITION AND INTERPRETATION
Applicable lawmeans laws, regulations, policies, guidelines, rules and requirements (whether legally enforceable or not) in relevant jurisdictions that govern the Company and/or Users (as applicable), including but not limited to Anti-Money Laundering, Anti-Terrorism Funding and Funding for the Proliferation of Weapons of Mass Destruction No. 8 of 2010, Law no. 9 of 2013, and other laws and regulations that may apply from time to time.

Collection at Branchmeans that the collection of Foreign Currency or Indonesian Rupiah exchanged by the User is carried out at the location chosen by the Company and at the time and date specified by the Company in the Ordering System.

Ordering System/Servicerefers to the online reservation service operated by the Company that facilitates the reservation of the User’s Foreign Currency at the applicable exchange rate which can be accessed by the User through the Website which is able to support the reservation of Foreign Currency and electronic payments (optional/mandatory) to secure Ordering Transactions or receiving Indonesian Rupiah through electronic payment services.

Foreign currency means the currency which is legal tender in a region outside Indonesia.

Faspay is the payment gateway (Payment Gateways) national online, jointly developed by financial institutions and owned by PT. Indonesian Media.

Company refers to PT Dharta Aljazeera Global, a company established under Indonesian law with offices in (Blok M Square, Ground Floor Blok AKS No. 282, Jl. Melawai V, Kebayoran Baru, South Jakarta) including its successors and assigns.

Transaction includes online booking reservations made by Users using the Ordering System or electronic payment services via QR codes.

User/Customer/You are individuals, corporations, partnerships, limited liability companies, associations or other bodies in any form, including currency wholesalers, money changers, banks licensed by Bank Indonesia, or government or government agencies or authorities, whose requests for services have been received by Company.

Visitors means any individual who is not a User accessing the Website.

Website means the website designated by the Company:aljazeeraglo.com which is
open to be accessed by Users and Visitors.

• Users must be at least 18 years of age with the following types of identification and are permitted under Applicable Law to enter into legally binding agreements.
• Old ID
• New ID
• Passport
• SIM
• Temporary Identity Card
• Permanent Residents
• Users must comply with the Customer Due Diligence requirements imposed by the Company and Applicable Laws.

CONFESSION
The user acknowledges and agrees that:

a. The Company has the sole and absolute discretion to determine and enforce limits for transactions made through the Ordering System either in quantity, frequency or otherwise in accordance with applicable Laws and that the Company has the absolute right to change these limits in accordance with the requirements/changes in Applicable Law.

b. The company can limit, refuse or refuse User’s requests to make Transactions at any time at the Company’s sole discretion without giving any reasons for that.

c. The company has the sole and absolute policy to determine whether Users can use Faspay services for electronic payments.

d. In addition to these Terms, Services may depend on the availability of Faspay services. Faspay is a separate legal entity and the use of Faspay services is subject to the terms, conditions and restrictions imposed by Faspay. The company is not obligated or responsible for losses suffered by users or other people arising from the use of Faspay services by users. The user must ensure and update the terms, conditions and limitations imposed by Faspay himself; Faspay Terms & Conditions.

e. The use of Faspay services for Users is currently free of charge. However, in the event that Faspay charges a new fee based on a Transaction carried out by the User in accordance with or related to these Terms, the User will bear it; Faspay Terms & Conditions.

f. Companies are required by laws and regulations to carry out security checks and
customer due diligence on you in order to provide you with the Services. You may need to provide additional information so that the Company can verify your identity as a condition of processing your request, or providing the Service to you. The company can make directly or through third parties, any request that the company deems necessary to validate the information you provide to the company, including using third party verification services.

g. Users must take all measures and steps that may be necessary to ensure that when exchanging Foreign Currency with the Company through Branch Collection, the Foreign Currency (i) is appropriate and recognized as legal tender for transactions; (ii) original banknotes; and (iii) is correct in terms of currency, amount and denomination and verified by receipt of the order. After the receipt acknowledged by the User, the Company will not be responsible for the User’s claim for counterfeit/counterfeit Foreign Currency, insufficient amount or wrong Foreign Currency denomination. However, the Company will use all reasonable efforts to investigate any reasonable claims made by Users.

PRICE MISTAKE
The Company makes every effort to provide you with accurate and up-to-date Service prices and information. Errors will be corrected if discovered, and Company reserves the right to retract the stated offer and to correct any errors, inaccuracies or omissions, including after the order has been placed and paid for by you, and whether or not the order has been placed. confirmed by the Company. If the actual price of the Services purchased by you is higher than the price reflected on our Website, we will notify you in writing via Email and you will be given the option to confirm or cancel the purchase of the Service based on the updated price. If you choose to confirm your purchase, you will need to make an additional payment to show the updated price. If you choose to cancel your purchase, we will refund any payment you made. If we are unable to contact you using the contact you provided during the order process, we will consider your order in connection with the incorrectly priced Service as canceled and notify you in writing.

TRANSACTION CANCELLATION
Any cancellation of Transactions by Users is governed by the Company’s cancellation policy which can be found here.

PROHIBITIONS AND LIMITATIONS
1. USERS CANNOT:

• use the Service in any way that will void other User(s)’s legal rights to use the service.
• use the Website for any purpose that is unlawful in any jurisdiction or violates these Terms.
• use the Services for unlawful or illegal activities or violate Applicable Laws.
• modify, copy, distribute, reproduce, transmit, display, perform, publish, upload, post, license, create derivative works from, transfer or sell any information, designs, logos, trademarks, software or services obtained from the Site Web.
• post or transmit any unlawful, deceptive, defamatory, libelous, obscene, pornographic, indecent, threatening, abusive, hateful, offensive, or objectionable information or statement in any form whatsoever without limitation, information or any statement that constitutes or encourages behavior tantamount to a criminal offence, gives rise to civil liability and/or violates Applicable Laws.
• post or send any message containing advertising material, touting or selling, or offering to sell, any product or service.
• send or distribute advertising materials, chain letters, spam, junk e-mail, or other types of unsolicited messages.
• post or transmit or distribute viruses, worms, trojan horses or other harmful, disruptive or destructive files.
• post, publish, transmit, reproduce, distribute or in any way exploit any information, software or other material obtained from or through the Website for commercial purposes.
• attempt to compile or reverse engineer any software available on the Website.
• attempt to hack the Website or attempt to subvert any firewall or other security measures of the Website.

.2. The Service contains messaging functions and other communication facilities; You only send and receive messages that are appropriate and related to certain forums/subject purposes only. 

3.Any software provided on, by, or through the Website for a specific purpose may be used only for that purpose and nothing else.

4.Users must comply with and not conflict with Applicable Law, without any legal restrictions of those jurisdictions relating to the use of the Service.

5. Service is only available in Indonesia. If for any reason the User uses the Service outside Indonesia, the Company cannot support the Service and the User’s use of the Service is at the User’s own risk including the risk that its use violates local laws in the country/jurisdiction.

LIMITATION OF LIABILITY
The Company’s responsibility to Users based on these Terms is very limited to returning Foreign Currency sold by the Company or returning the amount of Indonesian Rupiah received from the User by the Company (excluding fees, charges or expenses in any form including Faspay or bank fees that the User may bear ) in the event that the Company fails to take advantage of the collection of Foreign Currency purchased by the User (always subject to such failure not being caused by the actions or negligence of the User).

DISCLAIMER
Due to the dangers inherent in electronic distribution, the User agrees and accepts that the Service may not be available from time to time due to required maintenance, electronic or other system failures or interruptions (whether from the Company or any third party) or other interruptions. The Company, its suppliers and their respective affiliates, officers, distributors and employees will not be liable to the User for any Losses suffered by the User as a result or sources that do not express any form of endorsement by the Company. Any User seeking other sources should do so against the party providing the advice, product or service.
However, the Company requires all Users to comply with all relevant laws, as well as the regulations set forth on the Website, and ensures that laws and regulations are complied with and complied with. Without limitation, the User acknowledges that the Company is not responsible for the privacy and confidentiality of any personal information provided by the User to other linked websites in any way. The company does not warrant that the Service will be uninterrupted, secure, error-free, free of viruses or other harmful components.

The Company has absolute discretion without notification to Users, to make changes to the features that appear on the Website from time to time without restrictions on adding, changing or deleting these features. 

In order to substantiate any provision of these Terms, the Company does not guarantee the retention of any data stored by the User in the Ordering System and excludes all responsibility for loss of data.

COMPENSATION
The user must indemnify the Company, its directors, officers, suppliers, employees, subsidiaries, related companies, partners, distributors and affiliates for any and all losses suffered by the Company, its directors, officers, suppliers, employees, subsidiaries, related companies , partners, distributors and affiliates to anyone as a result of violations of these Terms of Use.

FORCE MAJEURE
The Company will not be responsible to the User for performance delays or non performance due to causes beyond the control of the Company (including but not limited to God’s Will, major currency devaluation, currency unavailability, Government or Legal mandates).

ASSIGNMENT
These terms of use cannot be transferred by the User.
JURISDICTION, GOVERNING LAW FOR LEGAL PROCEEDINGS
These terms are governed by and construed in accordance with Indonesian law and you agree to submit to the exclusive jurisdiction of the courts in Indonesia.

DISCLOSURE
Users hereby agree that the Company’s rights to User information and disclosure will be in accordance with the Company’s Privacy Policy. The User then agrees to store, collect and use all personal data provided by the User arising from the Service in accordance with the Privacy Policy as may be changed from time to time. In explaining and without prejudice to the clause above these Terms, the Company has the right to disclose part or all of the information about Users at a certain time and in a certain way, as permitted or required by Applicable Law to the relevant authorities.

SEPARATION
If any provision of these Terms of Use is declared by a judicial or other competent authority as null, voidable, illegal or unenforceable, those provisions will be separated from these Terms of Use and other provisions will continue to apply.

AMENDMENT
Company reserves the right to vary, replace and amend any or all of these Terms and post changes to its Services and post them on the Website. Users who continue to use the Services offered by the Company after such variations, changes and amendments are posted constitute the User’s agreement to be bound by it. Users will not have any guarantee against the Company for any Loss as a result of variations, changes, amendments or otherwise. No construction rules apply to the Company’s loss as Company is responsible for the preparation of this Agreement or any part thereof.

ENGLISH VERSION
In the event that these Terms are translated into a language other than English, it is done solely for convenience purposes, with only the English version of these Terms being valid and binding.

SUSTAINABILITY
The obligations of both parties under these Terms will survive the expiry or termination of this agreement.
